JUDICIAL STATISTICS NMCG – 2023: Employment Law Department – Employers
Another record year!
📈 The statistics below have been compiled to give you a better idea of our results in terms of litigation.
⭐️ A just reward for the motivation and hard work of our teams in assisting and defending our customers.
Challenging dismissals
80% of employees’ claims to have their dismissal deemed unfounded were dismissed in their entirety (75% dismissed in their entirety, and 5% of dismissals for serious misconduct requalified as dismissals for real and serious cause), including 15% where the employee was ordered to pay damages/article 700.
Or :
➞ + 10% compared to 2022!
➞ only 20% of employees win their case.
➞ 4 out of 5 redundancies attacked by our Employment Law department.
This percentage counts collective cases (e.g.: 150 employee claimants) as “1” single case, so as not to distort the statistics (it being specified that all of these deliberations, with a risk of several million euros for some, were in favor of NMCG in 2023).
All litigation files
(All procedures, all jurisdictions and all claims combined*)
74% departmental success rate
Or :
➞ + 10% compared with 2022 as well.
➞ more than 7 out of 10 cases are completely dismissed, with the employee/trade union being dismissed or the employee/trade union/IRP being convicted when the company is the plaintiff.
